Official sprites are fair game to edit - and in fact, editing of official sprites is how most fan sprites are made. The problem starts when people edit sprites other people made. As this is not the case here - the person literally took the HG/SS Super Nerd's robot and stuck it next to the HG/SS Waiter, both official sprites - it's kind of silly but not technically rule breaking.
